1. Acceptance of these terms.
By accessing or using losangelessocialanxiety.com (the "Site"), operated by Pasadena Clinical Group ("PCG", "we", "us"), you agree to these Terms and Conditions ("Terms"). If you do not agree, do not use the Site.
2. No medical advice; no clinician-patient relationship.
The content of the Site is provided for general informational purposes only and is not medical, psychological, legal, or other professional advice. Reading or interacting with this Site does not create a clinician-patient or doctor-patient relationship between you and PCG. Do not rely on Site content as a substitute for individualized professional care. If you are in a mental health emergency, call 911 or 988 or go to your nearest emergency room.
3. Intellectual property.
All content on the Site — including text, graphics, photographs, logos, and code — is owned by PCG or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual-property laws. Except for personal, non-commercial viewing, no part of the Site may be copied, reproduced, distributed, modified, or used for any commercial purpose without our prior written consent.
4. User submissions.
If you submit information through forms or by email, you represent that the information is accurate and that you have the right to share it. You grant PCG the right to use that information for the purpose of responding to your inquiry and providing services. Please do not include sensitive personal health information ("PHI") in unencrypted forms or email — see our Privacy Policy and Notice of Privacy Practices.
5. Third-party links.
The Site may include links to third-party websites for convenience. We are not responsible for the content, privacy practices, or security of third-party sites and do not endorse them.
6. Site uptime & changes.
We may modify, suspend, or discontinue all or any part of the Site at any time, without notice. We do not guarantee uninterrupted availability.
7. Disclaimer of warranties; "as is."
The Site and its content are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be error-free, uninterrupted, free of viruses, or that any information on the Site is current, complete, or accurate.
8. Limitation of liability.
To the maximum extent permitted by California law, PCG and its officers, employees, contractors, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site, even if advised of the possibility of such damages. PCG's total cumulative liability for any claim arising out of or related to the Site shall not exceed one hundred U.S. dollars ($100). This limitation does not apply to clinical malpractice claims governed by California's medical-injury framework, which are governed separately by California law.
9. Indemnification.
You agree to defend, indemnify, and hold harmless PCG and its officers, employees, contractors, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your violation of these Terms or your use of the Site.
10. Dispute resolution — mediation, then arbitration; "as-is" venue.
Step 1: Informal resolution. Before filing any formal proceeding, you agree to first contact PCG in writing at office@pasadenaclinicalgroup.com describing the dispute. The parties will negotiate in good faith for at least thirty (30) days.
Step 2: Mediation. If the dispute is not resolved informally, the parties shall submit the dispute to non-binding mediation in Los Angeles County, California, before a single mediator selected jointly by the parties or, if they cannot agree, appointed by JAMS in accordance with its mediation rules. Each party shall bear its own fees and share equally the mediator's fees.
Step 3: Arbitration. If mediation does not resolve the dispute within sixty (60) days, the dispute shall be finally resolved by binding arbitration administered by JAMS under its Streamlined Arbitration Rules, before a single arbitrator, in Los Angeles County, California. Judgment on the award may be entered in any court of competent jurisdiction. The arbitrator shall apply California law. The parties waive any right to a jury trial. The parties also waive any right to participate in a class, collective, or representative proceeding. This arbitration provision does not apply to clinical malpractice claims, which are governed by California's medical-injury framework, including the Medical Injury Compensation Reform Act ("MICRA"), and to the extent applicable separate written agreements with patients.
Governing law and venue. These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. For any dispute not subject to arbitration, the parties consent to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California.
11. Severability; entire agreement; modification.
If any provision of these Terms is found unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect. These Terms (together with our Privacy Policy, Cookie Policy, and any other agreements referenced) constitute the entire agreement between you and PCG regarding your use of the Site. We may modify these Terms at any time by posting an updated version on the Site.
